特别告知（二）Special Notices (II)
I. Before signing this contract, both the Seller and the Buyer shall be aware of housing purchase restriction regulations of the State and the City. Both the Seller and the Buyer agreed in this contract shall comply with purchase restriction regulations when transferring the housing. If the Buyer fails to provide truthfully the family information and housing information owned by family members, it shall be responsible for all legal and economic responsibilities including that “real estate registration will not be handled” caused hereby.
Implementation Opinions of Shanghai Municipal Government General Office on the Implementation of “Notice of General Office of the State Council on Further Doing a Good Job in the Control of the Real Estate Market” (HFBF (2011) No. 6) Article 7: “Provisionally, for the households with census register of this city owning 1 set of housing in this city already and the households without census register of this city but can provide the individual income tax payment certificate or social insurance (town social insurance) payment certificate in this city for more than 1 year accumulatively within the first 2 years from the date of housing purchase, they can purchase only 1 set of housing (including newly-built commercial housing and second-hand housing). For the households with census register of this city owning two or more housings in this city already, the households without census register of this city owning one or more housings, and the households without census register of this city and cannot provide the individual income tax payment certificate or social insurance (town social insurance) payment certificate in this city for more than 1 year accumulatively within 2 years, they shall be suspended to purchase housing in this city. In case of violation of regulations to purchase housing, the real estate registration will not be handled.”
The provisions of Article 3 of Shanghai Municipal People’s Government General Office Forwarding the Notice of Management Committee of Municipal Housing and Urban-rural Construction and Other Three Departments on Several Opinions on Further Improving the Municipal Housing Market System and Security System to Promote the Stable and Healthy Development of the Real Estate Market (HFBF (2016) No. 11): Extend the term of the individual income tax or social insurance to be paid by households without census register of this city for purchasing housing, and adjust accumulative payment for over two years within the first 3 years since the date of purchasing the housing to accumulative payment for five years or more since the date of purchasing the housing.
II. Before signing this contract, the Buyer can consult relevant tax and credit policies from the financial and taxation department and lending bank to know the taxes and dues concerning housing transfer and decide the payment method of housing price prudently.
